Information from other sources

In short: we obtain some business contact information from third-party data providers.

We may obtain business contact information from third-party data providers, including through our customer relationship management (CRM) platform, Smartdesk CRM. This may include your name, job title, company name, business email address, and business phone number. We use it to contact you about Services that may be relevant to your business. You can opt out of these emails at any time (see section 9).

Information collected automatically

In short: some technical details, like your IP address and browser type, are collected automatically when you visit our website.

When you visit our website, we automatically collect certain technical information. It does not directly identify you, but it helps us run, secure, and improve the site. It may include:

  • Log and usage data: your IP address, browser type and settings, pages you view, the date and time of your visit, and error reports.

  • Device data: the type of device, operating system, and internet provider you use.

  • Location data: your approximate location, usually based on your IP address. You can limit this through your device or browser settings, though some features may not work as well.

2. How do we use your information?

In short: to provide and improve our Services, communicate with you, keep things secure, and comply with the law. With your consent, we may also use it for other purposes.

Depending on how you interact with us, we use your information to:

  • Provide our Services. Deliver the work or service you asked for.

  • Respond to you. Answer your questions and help with any issues.

  • Ask for feedback. Follow up about your experience with our Services.

  • Send marketing emails. Share news, tips, and offers, if your preferences allow it. You can unsubscribe at any time (see section 9).

  • Show relevant ads. Tailor content and advertising to your interests and location.

  • Protect our Services. Monitor for and prevent fraud, abuse, and security threats.

  • Understand usage. See how people use our website so we can improve it.

  • Protect someone's safety. Act where needed to prevent harm to a person.

3. What legal bases do we rely on?

In short: we only process your information when the law allows it, for example with your consent, to fulfil a contract, to meet legal duties, or for legitimate business reasons.

If you are in Canada

We process your information with your express consent, or where your consent can reasonably be implied. You can withdraw your consent at any time (see section 9).

In limited cases, Canadian law allows us to process your information without consent. Examples include:

  • When it is clearly in your interest and consent cannot be obtained in time

  • To investigate or prevent fraud

  • For certain business transactions, such as a sale of the business

  • To respond to a subpoena, warrant, or court order

  • To investigate a breach of an agreement or a violation of the law

  • When the information is publicly available as defined by the regulations

4. When and with whom do we share your information?

In short: only in the situations below. We do not sell your personal information.

  • Service providers. Trusted vendors who help us run our business, such as our CRM and email platform (SmartdeskCRM), website hosting, scheduling, and analytics providers (e.g. Google Analytics, Calendly, Later). They may only use your information to perform services for us.

  • Business transfers. If we merge, sell assets, obtain financing, or are acquired, your information may be transferred as part of that deal.

  • Business partners. Partners who help us offer you certain products, services, or promotions.

  • Legal requirements. When required by law, or to protect our rights, our clients, or the public.

5. How do we use cookies and social logins?

Cookies

In short: we may use cookies and similar technologies to run and improve our website.

Cookies are small files stored on your device. We may use them to remember your preferences, understand how visitors use our site, and measure our marketing. You can block or delete cookies in your browser settings, though some parts of the site may not work properly without them.

Social logins

In short: if you sign in with a social media account, we may receive some of your profile information.

Where offered, you may sign up or log in using an account such as Instagram, X, Facebook, Google, or LinkedIn. If you do, we receive basic profile details from that provider, usually your name, email address, and profile picture, plus anything else you have made public there.

We use this information only as described in this policy. We do not control how your social media provider uses your information, so please review their privacy policy and settings.

6. How long do we keep your information?

In short: only as long as we need it, unless the law requires longer.

We keep your personal information only as long as needed for the purposes in this policy, or longer where the law requires it (for example, for tax or accounting records).

When we no longer need it, we delete or anonymize it. If that is not immediately possible, for example because it sits in a backup, we store it securely and stop using it until it can be deleted.

7. How do we keep your information safe?

In short: we use reasonable technical and organizational safeguards.

We take reasonable steps to protect your personal information from loss, misuse, and unauthorized access. Still, no website, internet transmission, or storage system is completely secure. We cannot guarantee that unauthorized parties will never get past our safeguards, so you share information with us at your own risk. Please use our Services only in a secure environment.

8. Do we collect information from minors?

In short: no. Our Services are not intended for anyone under 18.

We do not knowingly collect information from, or market to, anyone under 18. By using our Services, you confirm you are at least 18. If we learn we have collected information from someone under 18, we will delete it promptly. If you believe this has happened, please contact us at info@rainspark.ca

9. What are your privacy rights?

In short: depending on where you live, such as Canada, the EEA, or Switzerland, you may have rights to access and control your personal information.

Depending on applicable law, you may have the right to:

  • Access the personal information we hold about you and get a copy

  • Correct inaccurate information

  • Ask us to delete your information

  • Restrict or object to certain processing

  • Receive your information in a portable format

  • Not be subject to decisions made solely by automated means

To make a request, contact us using the details in section 13. We will respond as required by applicable privacy laws.

If you are unhappy with how we handle your information, you may also write to the privacy regulator: in Canada, the Office of the Privacy Commissioner of Canada; in the EEA, your local data protection authority; in Switzerland, the Federal Data Protection and Information Commissioner.

Withdrawing your consent. Where we rely on your consent, express or implied, you can withdraw it at any time by contacting us. This does not affect processing that happened before you withdrew it, or processing based on other legal grounds.

Opting out of marketing. You can unsubscribe from our emails at any time using the link in any email, or by contacting us. We may still send you non-marketing messages, such as replies to your requests or service-related updates.

10. Do-Not-Track signals

Some browsers offer a Do-Not-Track ("DNT") setting that tells websites you prefer not to have your browsing tracked. Because there is no agreed standard for how websites should respond to these signals, we do not currently respond to them. If a standard is adopted that we must follow, we will update this policy.

11. Do U.S. residents have specific privacy rights?

In short: residents of some U.S. states, including California, may have additional rights.

Under California's "Shine the Light" law, California residents may ask us once a year, free of charge, which categories of personal information (if any) we shared with third parties for their direct marketing in the previous calendar year, and the names and addresses of those third parties. To make this request, write to us using the details in section 13.

If you are under 18, live in California, and have an account with us, you may ask us to remove content you posted publicly on our Services. Email us from the address linked to your account and state that you live in California. We will remove it from public view, though copies may remain in backups.

12. Will we update this policy?

In short: yes, as needed to stay current with the law and our practices.

We may update this policy from time to time. The "Last updated" date at the top shows when it last changed, and changes take effect once posted. For significant changes, we may post a notice on our website or contact you directly. Please check back regularly.
